Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Reimbursa platform and services provided by Aptelligence, LLC, a Wyoming limited liability company, doing business as Reimbursa By accessing or using our services, you agree to be bound by these Terms.
Acceptance of terms
By creating an account or using the Reimbursa platform, you confirm that you are at least 18 years old, have the authority to enter into this agreement on behalf of your organization, and agree to these Terms and our Privacy Policy.
Description of services
Reimbursa provides workforce reimbursement intelligence services including, but not limited to: rules intelligence encoding, preflight QA for claim submissions, claim visibility and tracking, policy monitoring, and related tools accessible via our web platform and API.
Accounts and access
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at security@reimbursa.com of any unauthorized access to your account. We reserve the right to suspend accounts that violate these Terms.
Acceptable use
You agree not to:
- Use the platform to submit false or fraudulent reimbursement claims
- Reverse engineer, decompile, or extract our rules packs or proprietary data
- Resell, sublicense, or transfer access to the platform without written consent
- Introduce malicious code, bots, or unauthorized automated scraping
- Violate any applicable federal, state, or local law
Data and confidentiality
You retain ownership of all data you submit to the platform. By using our services, you grant Reimbursa a limited license to process your data solely to provide and improve the services as described in our Privacy Policy.
Reimbursa's proprietary rules packs, platform code, algorithms, and board intelligence data are confidential and may not be copied, distributed, or disclosed to third parties.
Fees and payment
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may modify pricing with 30 days advance notice. Continued use after a pricing change constitutes acceptance.
Disclaimers
Reimbursa provides decision-support intelligence, not legal advice. Our rules packs reflect our best interpretation of workforce board policies, but we make no guarantee of claim approval. You remain solely responsible for the accuracy of submitted claims.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REIMBURSA'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM. REIMBURSA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Termination
Either party may terminate this agreement at any time. Upon termination, your access to the platform will cease. Provisions that by their nature should survive termination will continue to apply.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules.
Changes to terms
We may update these Terms from time to time. We will notify you of material changes with at least 14 days advance notice. Continued use after the effective date constitutes acceptance.
The Retirement Credit Packet
Sections 1 through 11 above cover the subscription platform. This section covers the Retirement Credit Packet, a separate one-time product that costs $499. If anything in this section conflicts with the sections above for a Retirement Credit Packet purchase, this section controls.
The packet contains a Form 8881 worksheet, a memo addressed to your own CPA, a Section 127 educational assistance plan template, and a shortlist of 401(k) providers. We build it from the answers you give us in the intake form and from published federal law, and we cite our sources in the memo. The packet is:
- Not tax advice
- Not a tax return
- Not a legal opinion
Reimbursa is not a return preparer, not a fiduciary, and not a plan provider. We do not file anything on your behalf. Your own CPA or enrolled agent files your return.
By purchasing the packet, you agree not to put any figure from it on a tax return without your own CPA or enrolled agent reviewing it first. The packet describes a retirement plan you are planning to adopt, built from estimates you gave us. You agree to confirm every figure in it against your actual year end payroll and plan details before anyone files anything.
The analysis is only as good as what you tell us. You confirm that the answers you gave in the intake form are accurate and complete.
We make no warranty as to the amount of any credit or as to your eligibility for one. Our total liability for anything arising from the packet is limited to the $499 you paid for it.
Here is our guarantee. If the CPA or enrolled agent who prepares your return reviews the packet and tells us in writing that they will not use it, we refund your $499 in full. No other conditions. This guarantee is good until you file the return for the first credit year the packet covers. To claim it, email jason@reimbursa.comwith your accountant's note.
One more thing, in the interest of being straight with you: no licensed CPA has independently reviewed our methodology yet. Your own accountant reviewing the packet before you file is the review, and that is exactly why we require it.
SMS terms (Reimbursa text alerts)
Program. Reimbursa text alerts send deadline reminders and updates about requests you made on reimbursa.com, such as state retirement mandate deadlines and your Federal Money Check.
How you join. You check the optional text message box on one of our forms and give a mobile number. Joining is never required to use the site, get a download, or buy anything.
Frequency. Up to 4 messages a month. Message and data rates may apply.
Reply STOP to cancel at any time. Reply HELP for help. After you reply STOP we send one message confirming you are unsubscribed and no more after that. For help you can also email hello@reimbursa.com.
Carriers are not liable for delayed or undelivered messages. Your mobile information is handled as described in our Privacy Policy; we do not share it with third parties for marketing.
